The right to rehabilitation of persons with disabilities: theoretical and legal analysis
Review
The article aims to conduct a comprehensive analysis of the legal and social aspects of rehabilitation for persons with disabilities in Ukraine, clarify the theoretical principles of the right to rehabilitation, and identify current implementation issues of this right. Methodology. It involves a multidimensional approach to analysis, encompassing the examination of scientific literature and legislation concerning rehabilitation in Ukraine, as well as employing sociological research methods such as surveys or interviews to gather and analyze opinions and experiences of stakeholders in the rehabilitation process. Additionally, comparative analysis of international rehabilitation practices will be utilized to explore effective strategies applicable to the Ukrainian context.
The theoretical-legal analysis of the realization of the right to rehabilitation as a distinct right of persons with disabilities is conducted in the article, considering the relevance of the topic amidst the increasing number of people with disabilities in Ukraine and the necessity of adopting the best contemporary rehabilitation practices. The article analyzes the rights of persons with disabilities to rehabilitation in the legislation of Ukraine. Special attention is paid to the analysis of individual articles of the Laws of Ukraine «On rehabilitation in the field of health care» and «On rehabilitation of persons with disabilities in Ukraine».
The main aspects that regulate the right to rehabilitation are defined, such as participation in determining the goal and tasks of rehabilitation, the right to dignified and humane treatment by specialists, the right to confidentiality of information, as well as the right to refuse rehabilitation measures. It is proven that the legislation of Ukraine provides a comprehensive approach to rehabilitation aimed at restoring and maintaining the physical, mental and social well-being of persons with disabilities. However, it was found that some normative provisions have a declarative nature and do not contain clear mechanisms for their implementation, which leads to problems in ensuring the rights and needs of this category of citizens.
The most significant aspects that are important for ensuring effective rehabilitation of persons with disabilities in Ukraine are highlighted. Offers an in-depth theoretical and legal analysis of the issue of the right to rehabilitation for persons with disabilities in Ukraine, revealing key aspects of the legislation.
Conclusions. It was concluded that the right to rehabilitation in Ukraine is fundamental and integral to ensuring a dignified life for persons with disabilities. The country’s legislative framework defines the basic principles and approaches to rehabilitation, but it needs further development and adaptation to the current needs and challenges facing society. The need to improve legislation, develop effective mechanisms for the implementation of rehabilitation measures, as well as ensure comprehensive support and access to rehabilitation services are key to solving existing problems in this area.
The conclusions emphasize the need for further improvement of the legislative framework and the development of specific mechanisms for the effective implementation of the right to rehabilitation. The importance of expanding individual rehabilitation plans, increasing the availability of rehabilitation services, involving the public and persons with disabilities in the process of planning and evaluating rehabilitation programs, creating a barrier-free environment and developing a system for monitoring the effectiveness of rehabilitation measures is also indicated.
